Liability waiver
Every runner (or their parent or legal guardian, for runners under 18) accepts this waiver as part of registration. It is reproduced here so you can read it before you register. Waiver version 2026-1.
Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement
In consideration of being permitted to participate in the XC5K cross-country 5K run held on November 7, 2026 (the "Event"), organized as a fundraiser for Scouting America Troop 268 and hosted at Chamblee First United Methodist Church, Chamblee, Georgia, I agree as follows:
- Assumption of risk. I understand that running a cross-country race is a potentially hazardous activity. The course includes wooded trails, open fields, and asphalt surfaces, and its hazards include but are not limited to uneven ground, roots, rocks, mud, slippery surfaces, low branches, weather conditions, vehicular traffic near road sections, and contact with other participants. I am voluntarily participating with full knowledge of these risks, and I assume all risk of injury, illness, or property damage arising from my participation.
- Fitness to participate. I certify that I am physically fit and sufficiently trained to complete the Event, and that a licensed medical professional has not advised me otherwise.
- Release. I, for myself and my heirs, assigns, personal representatives, and next of kin, hereby release, waive, and discharge Scouting America Troop 268, its chartered organization Chamblee First United Methodist Church, Scouting America, and each of their officers, volunteers, agents, employees, sponsors, and representatives (collectively, the "Released Parties") from any and all claims, demands, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by me, or to any property belonging to me, while participating in the Event, to the fullest extent permitted by law.
- Indemnification. I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost they may incur arising out of my participation in the Event.
- Medical authorization. I authorize the Event organizers to secure emergency medical treatment on my behalf if I am injured or incapacitated during the Event, at my expense.
- Photo and likeness release. I grant the Event organizers permission to use photographs and video of me taken at the Event for race promotion and troop communications, without compensation.
- Minors. If the registered participant is under 18 years of age, I certify that I am the participant's parent or legal guardian, that I agree to all of the terms above on the participant's behalf, and that I accept them on my own behalf as well.
By checking the waiver box on the registration form I acknowledge that I have read this agreement, understand that it is a release of liability, and agree to it voluntarily.
